1. About these terms

These terms govern access to and use of the Sell My Car Essex Marketplace website, dashboards, portals, messaging tools and related online services.

Seller transactions are also governed by the Seller Marketplace Terms. Dealers are also bound by the Dealer Terms and Conditions, Dealer Fee Schedule and Dealer Code of Conduct.

3. Accepting these terms

By using the website, you agree to follow these terms. If you register, create a Listing or submit an offer, you will also be asked to accept the terms applicable to that activity.

If you do not agree, you should stop using the website.

4. Our Marketplace

The Marketplace connects invited vehicle Sellers with approved motor Dealers.

Unless we expressly state otherwise, we do not own Marketplace Vehicles, make Dealer Offers, purchase Vehicles on the Marketplace or become a party to a Vehicle transaction.

Valuations, guide prices and third-party vehicle information are estimates or information tools. They do not guarantee a sale, purchase price or Vehicle condition.

5. Accounts

You must provide accurate and current registration information and keep your login credentials secure.

You are responsible for activity through your account. You must notify us promptly if you believe it has been accessed without authority.

You must not create a false identity, impersonate another person or business, share an account with an unauthorised user or attempt to bypass verification.

6. Permitted use

You may use the website only for lawful purposes and in accordance with the terms applying to your account.

You must not:

• gain or attempt to gain unauthorised access;
• introduce malware or harmful code;
• interfere with the website, servers, users or security controls;
• scrape, crawl, harvest or systematically extract data;
• copy, sell or republish Listings or personal information;
• reverse engineer, decompile or reproduce the service except where the law expressly permits it;
• submit false, misleading or fraudulent information;
• manipulate offers, reviews or transaction outcomes;
• harass another user;
• use another person’s personal information unlawfully; or
• use the website in a way that could damage the Marketplace or another person.

7. Uploaded material

You are responsible for material you upload or submit.

You must have the right to use it, and it must not be unlawful, misleading, abusive, defamatory, obscene, infringing, malicious or unrelated to the relevant Marketplace activity.

You grant us a non-exclusive, royalty-free licence to store, process, resize and display submitted material for the purpose of operating, securing and administering the website and relevant transaction. This licence lasts only for as long as reasonably required for those purposes and lawful record keeping.

Personal information contained in uploaded material is handled in accordance with our Privacy Policy.

8. Intellectual property

We or our licensors own the website, branding, original content, software, databases and page designs.

You may view and use the website for its intended purpose. You may not reproduce, distribute, modify, commercially exploit or create a competing database from our content without written permission.

Vehicle photographs and Seller content remain subject to the rights of the person who supplied them. Access to a Listing does not give a user the right to reuse its photographs or description elsewhere.

9. Reviews and communications

Reviews must be based on a genuine experience and must not be fake, misleading, unlawfully incentivised, abusive or contain unnecessary personal information.

Messages must relate to the relevant Marketplace activity and must remain professional. We may investigate reported content and remove or restrict material that breaches these terms or applicable law.

We will not remove an honest negative review merely because the reviewed party disagrees with it.

10. Third-party information and links

The website may contain vehicle data, valuation information or links supplied by third parties.

Third parties are responsible for their own websites, services and privacy practices. We do not guarantee that third-party information is complete, current or error-free.

Users should complete appropriate checks and consult official sources where necessary.

11. Website availability and security

We aim to provide a secure and reliable service but do not guarantee that the website will always be available, uninterrupted or free from errors.

We may suspend or change the website for maintenance, security, technical, fraud-prevention, operational or legal reasons.

You are responsible for using suitable device security and protecting your account credentials.

12. Suspension and removal

We may restrict or suspend access, remove content or close an account where we reasonably believe that:

• these terms or another applicable policy have been breached;
• the account or content creates a security or safety risk;
• information is fraudulent, unlawful or materially misleading;
• another user is being harmed or harassed;
• fees remain unpaid; or
• action is required by law or a competent authority.

Where appropriate, we may investigate before making a final decision.

13. Our responsibility

We do not exclude responsibility that cannot legally be excluded.

Nothing in these terms limits liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation or another liability that the law does not allow us to limit.

Different liability provisions apply to Sellers and Dealers under their respective terms.

We are not responsible for loss caused by a user’s failure to protect login information, reliance on unofficial third-party data, or use of the website in breach of these terms.

15. Changes

We may update these terms when the website, services or legal requirements change.

The latest version will be published with the updated date shown at the top. We may notify registered users of a material change by email or through their account.

Changes to an active Listing, offer or transaction will be handled under the specific Seller or Dealer Terms applicable when that activity began, unless a change is required by law or is necessary for security or fraud prevention.

16. General

If we delay enforcing a right, that does not mean we have waived it.

If part of these terms is invalid or unenforceable, the remaining provisions will continue.

These terms do not create a partnership, joint venture, employment or agency relationship.

These terms are governed by the law of England and Wales. Consumers living elsewhere in the United Kingdom retain any mandatory protections provided by the law and courts of the country in which they live.
